Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and SmartData Technologies Kft. governing your access to and use of FirstApp. Please read them carefully. By creating an account or using the Service, you accept these Terms.

FirstApp is an AI-assisted platform that turns your plain-language prompts into web applications, lets you preview and refine them, and can build and deploy them — optionally to your own custom domain. The Service is provided on a software-as-a-service basis and may evolve over time as we add, change or remove features.

3. Eligibility and accounts

• You must be at least 16 years old (or the age of digital consent in your country) and able to enter into a binding contract.
• You must provide accurate account information and keep it up to date.
• You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at privacy@firstapp.app of any unauthorised use.
• If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

4. Acceptable use

You agree not to, and not to permit others to:

• use the Service to build, host or distribute content that is unlawful, infringing, defamatory, harmful, malicious, or that violates the rights of others;
• generate malware, phishing pages, spam infrastructure, or content that facilitates fraud or illegal activity;
• attempt to gain unauthorised access to, disrupt, overload, reverse engineer or circumvent the security of the Service or its infrastructure;
• use the Service to develop a competing product by copying or extracting it, or resell the Service without our written consent;
• exceed usage limits, evade quotas, or use automated means to abuse the Service.

We may suspend or terminate access that violates this section, and we may remove content that breaches these Terms or the law.

5. Your content and ownership

You retain all rights you hold in the prompts, data, code and materials you submit or generate through the Service ("Your Content"). Subject to your compliance with these Terms, the applications you generate are yours to use and deploy.

You grant us a limited, worldwide, non-exclusive licence to host, process, transmit and display Your Content solely to operate, secure and provide the Service to you. You are responsible for Your Content and for having the necessary rights to it. You warrant that Your Content does not infringe third-party rights or violate applicable law.

6. AI-generated output

The Service uses AI models to generate code and content. AI output can be inaccurate, incomplete or unsuitable for a given purpose, and similar output may be generated for other users. You are responsible for reviewing, testing and validating any generated application before relying on it or deploying it to production. We do not warrant that generated output is error-free, secure, non-infringing, or fit for a particular purpose.

7. Deployment and custom domains

If you deploy an application or connect a custom domain, you are responsible for lawfully controlling that domain, for the content you publish, and for compliance with applicable laws (including privacy and consumer law) toward your own end users. Deployment relies on third-party edge infrastructure and is subject to its availability.

8. Plans, fees and payment

Some features are offered under paid plans. Fees, billing cycles and plan limits are described at the point of purchase. Unless stated otherwise, fees are exclusive of applicable taxes (including VAT), are charged in advance, and are non-refundable except where required by law. We may change pricing prospectively with reasonable notice; changes do not affect the current paid period. If you are a consumer in the EU, statutory withdrawal rights may apply — note that where you request immediate provision of digital services, the right of withdrawal may lapse once performance has begun with your consent.

9. Third-party services

The Service integrates third-party providers (for example cloud hosting, AI model providers and payment processors). Your use of those integrations may be subject to their terms, and we are not responsible for third-party services outside our control.

10. Our intellectual property

The Service, including its software, models, design, trademarks and documentation, is and remains the property of SmartData Technologies Kft. and its licensors. Except for the rights expressly granted to you, no rights are transferred. "FirstApp" and our logo are our trademarks and may not be used without permission.

11. Availability and changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may modify, suspend or discontinue features. We will give reasonable notice of material adverse changes where practicable.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This section does not limit any warranty or statutory right that cannot be excluded under applicable mandatory law, including consumer rights.

13. Limitation of liability

To the maximum extent permitted by law, SmartData Technologies Kft. shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Service. Our aggregate liability for all claims relating to the Service in any 12-month period shall not exceed the greater of (a) the amounts you paid us for the Service in that period, or (b) EUR 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or for infringement of mandatory statutory consumer rights.

14. Indemnity

You agree to indemnify and hold harmless SmartData Technologies Kft. from claims, liabilities, damages and expenses (including reasonable legal fees) arising from Your Content, your deployed applications, or your breach of these Terms or of applicable law, except to the extent caused by us.

15. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, liability, and governing law) will survive. We will handle your data on termination as described in our Privacy Policy.

16. Governing law and disputes

These Terms are governed by the laws of Hungary and, where applicable, the European Union, without regard to conflict-of-laws rules. The courts of Hungary shall have jurisdiction over disputes, subject to any mandatory consumer-protection rules that entitle a consumer to bring proceedings in, or benefit from the law of, their country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17. General

These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. We may update these Terms; we will post the revised version here and, for material changes, provide notice. Continued use after the effective date constitutes acceptance.
